V. Lomonosov. The conference was organized by Moscow State University named after M. V. Lomonosov, Moscow Branch of the Association of Lawyers of Russia, the Regional Public Organization "Alumni Association of the Law Faculty of Moscow State University", the Publishing Group "Lawyer" and Publishing House "The Legal House "Yustitsinform"'. This conference is the fourth scholastic event at the Law Faculty of Moscow State University for the past two years devoted to consideration of the problems of application of the legislation on public procurement (a conference on this topic is held annually in the summer, and a round table – in the fall). The conference is dedicated to the study of the main problems of the application of the Federal Law of April 5, 2013 No. 44 FZ "On the contract system in the procurement of goods, works and services for state and municipal needs" (Law No. 44 FL), the Federal Law of 18 July 2011 № 223 FZ "On procurement of goods, works, services, certain types of legal entities" (Law No. 223 FZ) and other normative instruments regulating relations in the sphere of public procurement. This collection includes articles by well known specialists in the legal regulation of relations in the sphere of state, municipal, "corporate" and other public procurement. The authors of the articles are scholars, government officials, employees of contracting authorities and of those acting as suppliers in public procurement, representatives of NGOs, independent experts and practitioners. We believe that the information contained in a collection of these materials will be of interest not only for government employees or representatives of entities that are directly covered by the legislation on public procurement, but also other professionals involved in the problems of legal regulation of relations in the sphere under consideration.

We hope that the holding of such research activities on the application of the legislation on public procurement in the circle of recognized experts will become a tradition, and the meeting in the designated format will be held at the Law Faculty of Moscow State University on a regular basis. We invite all concerned public procurement specialists, and also thank all the participants of the conference for the shown interest in it and submission of the materials for publication.

Одной из главных целей заказчика при осуществлении закупок в соответствии с положениями Федерального закона от 5 апреля 2013 года № 44 ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для государственных и муниципальных нужд» (далее – Закон о контрактной системе), в том числе и при осуществлении закупок проектных и изыскательных работ, является поиск такого исполнителя (подрядчика), который смог бы выполнить со своей стороны все обязательства, предусмотренные контрактом или гражданско правовым договором (далее – контракт), по минимальной цене, в минимальные сроки и с обеспечением требуемого уровня качества.

При этом в подавляющем большинстве случаев цена контракта, заключаемого по результатам закупки, снижается в процессе торгов, оказываясь в среднем на 5-30 процентов ниже сметной стоимости, определенной по нормативной документации.

Стоит отметить, что организация закупок проектных и изыскательных работ в Российской Федерации имеет определенные недостатки. К которым можно отнести:

– цена в качестве основного критерия при определении исполнителя (подрядчика) способом аукциона в электронной форме;

– необоснованное занижение цены контракта, предлагаемой исполнителем (подрядчиком) в процессе осуществления закупки;

– недостаточную регламентацию в вопросах установления и обоснования начальной (максимальной) цены контракта;

– ограниченный набор механизмов, помогающих заказчику защититься от недобросовестных действий исполнителя (подрядчика);

– отсутствие параметров и процедур проведения предварительной квалификации.

Целью настоящей статьи является определение мер, направленных на повышение эффективности осуществления закупок проектных и изыскательных работ в соответствии с требованиями Закона о контрактной системе. Поэтому в рамках настоящей статьи рассмотрим общее развитие подрядных торгов в Российской Федерации и существующие схемы проектирования и строительства объектов, исследуем опыт организации и осуществления закупок, разработаем рекомендации по повышению эффективности осуществления закупок проектных и изыскательных работ. Кроме того рассмотрим конкретные вопросы осуществления проектных и изыскательных работ на основании нормативно правовых актов, нормативно технических документов и сложившейся практики контролирующих органов.
